Good day to all! On 5.10.2017, I bought an Apple Watch Series 1 42 mm SpGr in the Citrus store (55 Dmitry Yavornitsky Ave., Dnipro) as a gift to my girlfriend, but it so happened that the relevance of the gift became lost. The watch was turned on only to charge it and lay on the bedside table. After a while, I came to return a gift that was no longer relevant. Initially, a girl with a very beautiful name worked with me (but, unfortunately, it is very rare and I did not remember it) Everything was fine. But then she discovered some kind of scratch on the screen. The scratch is visible only at some angle and in good light. The watches were sold from the window (although initially the girl told me that they tracked the movement of goods, and they were allegedly sold from a warehouse), accordingly, I cannot be sure that this scratch was put by me or my girlfriend. The seller who worked with me that day and sold me this watch naturally said that the watch was really from the window, but there were no scratches. OF course, but what else will he say? The receptionist said that this was not a problem and advised her to take the watch back, saying that they would definitely sell, but she decided to show the director more. The director came and then the whole service collapsed: he was rude and did not communicate with me directly. He sat down next to the girl and began to pretend that he was working (shifting some papers from place to place). All my questions were answered by a girl, and if he wanted to ask me something, he asked the girl, and I answered him. As a result, I left that day without achieving my goal, although the girl said several times that this was not a significant problem, and she would have taken the watch back, but was afraid of the director's reaction. I also asked the other seller later if there was an opportunity to return such an item. He said that sometimes we turn a blind eye to the fact that the goods we used are being brought. Accordingly, I could have already bought a watch that was returned one day with this scratch. The girl said that I was obliged to carefully inspect the goods when buying, but I trusted the store and did not look for a needle in a haystack. There is no such clause in the Law of Ukraine "On Consumer Rights Protection" that I am obliged to do this. In accordance with part 3 of Article 4 of the Law of Ukraine "On Consumer Rights Protection", the consumer is obliged to:
1. before using the product, carefully read the operating rules set out in the documentation provided by the manufacturer (seller, contractor) for the product;
2. if it is necessary to clarify the terms and conditions of use of the goods - before using the goods, seek clarification from the seller (manufacturer, contractor) or another person specified in the operational documentation performing their functions;
3. use the product according to its intended purpose and adhere to the conditions (requirements, norms, rules) established by the manufacturer of the product (contractor) in the operational documentation;
4. in order to prevent negative consequences for the consumer of using the product, apply the safety measures provided by the manufacturer in the product in compliance with the special rules provided for in the operational documentation, and in the absence of such rules in the documentation, adhere to the usual reasonable safety measures established for goods of this kind.
There is no word that I am obliged to review the product. I trusted Citrus and didn't look for anything.
Then I left the city on business, and after a while I wrote a review under the product on the store's website with a problem, there was no response for a long time. Perhaps this comment did not pass moderation, and thus there was an attempt to hide this situation from any site visitor who could read it. I also contacted the Citrus support service via Telegram. As a result, I received an answer that they could only accept the product of proper quality, that they were selling it again, and also that, again, I was obliged to inspect it. But as I said earlier, the girl herself said that sometimes they take back the goods that were in operation, respectively, the goods are already being sold. I was asked to write a statement addressed to the store administration asking to consider this case. I went to the store, and again the same girl kindly gave me the opportunity. On 16.10.2017, I wrote this statement and took a copy for myself. My name, surname, and patronymic were clearly written in the application, as well as the girl took a scanned copy of my passport. The promised deadlines sounded like "up to two weeks." I will clarify that the girl explained: "We send these statements to our lawyers, but they are not in the Dnieper. As soon as we receive a response, we will dial you and inform you about it." Yesterday, on 10/26/2017, I received a scanned copy of the response in Viber (with the date of 10/24/2017, that is, they could not send it in any way before.) This document set out everything, the same thing that I had already heard. In addition, this is a legal document if the statements were sent to lawyers, in which the initials of the name are indicated incorrectly. Accordingly, this decision is not for me, or it was an attempt to offend me, because it is not just a piece of paper, it is a legal document. After two weeks, I can quite come and say: "Where is the conclusion" ...? I hope that the situation will still be resolved in my favor, because I do not see my fault....
And I'm also wondering why I got a printout and not a fiscal receipt. After all, once I made a return of a defective product and I received a fiscal receipt for a refund…
